By placing an order on ELITCG, you confirm that you have read and accepted these Terms & Conditions.
1. Scope
These Terms & Conditions apply to sales of products offered by ELITCG to customers through our online store.
They apply alongside our Shipping & Returns Policy, Privacy Policy and any specific information displayed on individual product pages.
Mandatory rights granted to consumers by applicable law remain unaffected by these Terms.
2. Products
ELITCG specialises in authentic Trading Card Game products, including sealed products, booster packs, booster displays, collection boxes, Elite Trainer Boxes, accessories and other collectible items.
We only sell genuine products sourced through suppliers, distributors or other legitimate commercial channels.
Product descriptions are provided as accurately as possible. Customers should carefully check information such as:
product name, language, edition, region, contents, release date and condition before completing an order.
Minor variations in packaging, manufacturing marks or promotional artwork may occur between production batches without affecting the authenticity of the product.
3. Product Images
Product images are provided to help customers identify the item being sold.
Manufacturers may occasionally modify packaging, promotional markings or product presentation. Where these differences do not materially change the product ordered, such variations do not constitute a different product.
We will never intentionally substitute a different edition, language or product without informing the customer.
4. Prices
Prices displayed on ELITCG are shown in the currency selected or displayed by the store.
The final amount payable, including applicable taxes, shipping charges and any other charges collected by ELITCG, is displayed before the order is confirmed.
Prices may change at any time for future orders. A price change will not affect an order that has already been validly confirmed.
Promotional offers and discount codes may be subject to specific conditions and availability.
5. Payment
Payment is required when placing an order unless otherwise expressly stated.
Available payment methods are displayed at checkout and are processed through secure payment providers.
An order may not be processed if payment is refused, cancelled, reversed or flagged for additional verification by the payment provider.
ELITCG reserves the right to request reasonable additional information where necessary to prevent fraud or unauthorised transactions.
6. Order Confirmation
After placing an order, you will receive an electronic confirmation containing your order information.
Customers are responsible for checking the information entered during checkout, including the delivery address, email address and products ordered.
If you notice an error, contact help@elitcg.com as quickly as possible.
Once an order has entered preparation or shipping, changes may no longer be possible.
7. Availability
Products are offered subject to availability.
In the exceptional event that a product becomes unavailable after an order has been confirmed and ELITCG is unable to fulfil the order, the customer will be informed and the affected amount will be refunded.
We will not replace an unavailable product with a different product without the customer's agreement.
8. Pre-Orders
Products clearly marked Pre-Order are sold before their expected release or before they arrive in our available inventory.
Release and availability dates are based on information supplied by manufacturers, publishers, distributors or suppliers and may change.
If a release is delayed, the corresponding pre-order remains valid and will be shipped once the product becomes available.
Where possible, customers may contact help@elitcg.com to request cancellation of a pre-order before dispatch.
If a supplier ultimately cancels a product or our confirmed allocation does not allow us to fulfil an affected pre-order, the customer will be informed and refunded for the unavailable product.
Orders containing both pre-order and in-stock products may be shipped once all items are available. Customers who require in-stock items immediately should place them in a separate order.
9. Shipping & Delivery
ELITCG ships internationally.
Available delivery services, shipping costs and estimated delivery times are displayed during checkout according to the destination.
Where free shipping on orders over $150 is available, eligibility may depend on the destination and available shipping methods.
The delivery date or delivery period communicated during the ordering process forms part of the information provided to the customer. Under French and EU consumer rules, sellers must communicate delivery conditions and timing, and where no specific time has been agreed, EU rules generally require delivery within 30 days.

10. International Orders & Customs
Orders delivered outside the applicable customs territory may be subject to import duties, local taxes, customs clearance charges or carrier fees.
Where these amounts have not been collected by ELITCG during checkout, they may be payable by the recipient.
Customers are responsible for checking any import restrictions or charges applicable in their destination country.
11. Risk During Delivery
ELITCG remains responsible for the order until it is delivered to the customer, except where the customer independently arranges a carrier that was not offered by ELITCG.
If an order is lost or materially damaged during transport, please contact help@elitcg.com.
EU consumer rules place responsibility for goods on the professional seller until the consumer receives them when the seller arranged the delivery.
12. Right of Withdrawal
Consumers who benefit from the statutory European right of withdrawal generally have 14 days from receipt of the goods to withdraw from an online purchase without having to provide a reason.

Nothing in these Terms limits any mandatory statutory right of withdrawal.
13. Condition of Returned Collectibles
Trading Card Game products can lose substantial collectible value when manufacturer seals, wrapping or packaging are opened or altered.
Customers exercising a statutory right of withdrawal may inspect a product as reasonably necessary to determine its nature and characteristics.
Where legally permitted, the customer may be responsible for any diminished value resulting from handling beyond what is reasonably necessary for such inspection.
This provision does not remove or restrict mandatory consumer rights.
14. Return Shipping
For a standard change-of-mind return made under the right of withdrawal, direct return shipping costs are normally borne by the customer where this has been communicated in advance, except where applicable law provides otherwise.
Customers should use appropriate packaging and are strongly encouraged to use tracked delivery when returning valuable collectible products.
15. Refunds
Once an eligible return has been received and processed, the applicable refund will be issued using the original payment method unless otherwise agreed or required by law.
Refund processing times after issuance may vary depending on the bank or payment provider.
Mandatory statutory refund deadlines remain applicable.
16. Faulty, Damaged or Incorrect Products
If you receive a product that is defective, materially damaged, incorrect or does not correspond to the product ordered, please contact help@elitcg.com promptly.
Customers may be asked to provide photographs of the product, shipping package and relevant damage to help us investigate the issue.
This does not replace or restrict the customer's statutory rights.
17. Legal Guarantee of Conformity
Consumers purchasing goods from a professional seller within the European Union benefit from a minimum two-year legal guarantee for goods that are defective or do not correspond to their description.
Depending on the circumstances and applicable law, remedies may include repair, replacement, a reduction in price or reimbursement.
Commercial or manufacturer warranties, where offered, do not replace the statutory legal guarantee.
18. Collectible Product Condition
Many products sold by ELITCG are collectibles.
Small manufacturing imperfections to outer packaging, shrink wrap, cardboard, print alignment or similar cosmetic characteristics may occasionally occur during production and distribution.
However, this does not prevent customers from exercising any rights available where a product is materially damaged, defective, incorrectly supplied or legally non-conforming.
19. Free Gifts & Promotional Items
ELITCG may occasionally include promotional gifts, complimentary boosters or other extras with eligible orders.
Unless expressly stated as part of the purchased product, complimentary items are offered subject to availability and are not guaranteed for every order.
Promotional campaigns may be limited by date, quantity, customer eligibility or other clearly communicated conditions.
20. Authenticity
ELITCG is committed to selling authentic Trading Card Game products only.

21. Intellectual Property & Trademark Disclaimer
ELITCG and SERINITYMERCH are independent retailers.
ELITCG is not affiliated with, endorsed by, sponsored by or officially connected with The Pokémon Company, The Pokémon Company International, Nintendo, Creatures Inc. or GAME FREAK Inc.
Pokémon names, logos, characters, artwork and related trademarks belong to their respective owners.
Other Trading Card Game names, trademarks, logos and intellectual property displayed on the website also remain the property of their respective rights holders.
Their use on ELITCG is solely for the identification and sale of genuine products.
22. Website Content
We make reasonable efforts to keep product information, availability, release dates and other website content accurate and up to date.
Errors may occasionally occur.
Where an obvious technical or pricing error affects an order, ELITCG will contact the customer before proceeding where necessary and will comply with applicable consumer law.
23. Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be prohibited by law.
ELITCG is not responsible for losses resulting from circumstances outside its reasonable control except where applicable law places responsibility on the seller.
Nothing in this section limits mandatory consumer protections relating to delivery, conformity, defective goods or other statutory rights.
24. Personal Data
Personal information provided when using ELITCG is processed in accordance with our Privacy Policy and applicable data-protection legislation.

25. Consumer Complaints
If you have a complaint regarding an order or product, please contact us first so that we can attempt to resolve the matter directly.

26. Consumer Mediation
In France, professional sellers must give consumers access to an approved consumer mediator and publish that mediator's name, contact details and website on their website and in their Terms & Conditions.
After an unsuccessful attempt to resolve a dispute directly with ELITCG, eligible consumers may refer the matter to the consumer mediator designated by SERINITYMERCH.

In accordance with French consumer law, after first submitting a written complaint to ELITCG and if the dispute has not been resolved, the consumer may refer the matter free of charge to CM2C, the consumer mediator appointed by SERINITYMERCH.
27. Governing Law & Disputes
These Terms & Conditions are governed by French law.
Where the customer is a consumer residing in another country, this choice of law does not deprive that customer of any mandatory protection granted by the laws applicable to them.
Any dispute will be handled by the courts having jurisdiction under the applicable legal rules.
Before commencing legal proceedings, customers are encouraged to contact ELITCG and, where applicable, use the consumer mediation procedure described above.
28. Changes to These Terms
ELITCG may update these Terms & Conditions when necessary to reflect changes to our services, business practices or applicable regulations.
The Terms applicable to an order are those in force when the order is placed, subject to mandatory legal provisions.
